Terms of Service
[Draft] This English edition is being prepared for the international service and is under legal review. Where it differs from the Korean edition, the Korean edition governs the Korean service and this edition governs the international service.
Article 1 (Purpose)
These Terms set out the conditions and procedures for using the internet service operated by Joytalk (the "Operator") at joy-talk.com and related domains (the "Service"), together with the rights, duties and responsibilities of the Operator and its members.
Article 2 (Definitions)
- "Service" means the online venue the Operator runs using information and communications facilities in order to provide information and community services to members.
- "Member" means a person who has registered an account by providing personal data to the Service, and who may continuously receive information from and use the Service.
- "Non-member" means a person who uses the Service without registering an account.
- "Operator" means the party that manages and operates the Service.
- "Content" means any information a Member posts or uploads to the Service, including posts, comments, files and links.
Article 3 (Publication and Amendment of these Terms)
- The Operator publishes these Terms within the Service so that Members can read them easily.
- The Operator may amend these Terms to the extent permitted by applicable law.
- Where the Operator amends these Terms, it will announce the amended Terms alongside the current Terms, stating the effective date and the reason, at least 7 days before the effective date. Where an amendment is unfavourable to Members, the announcement will be made at least 30 days before the effective date.
- A Member is entitled to refuse an amendment. If a Member does not object before the amendment takes effect, the Member is deemed to have accepted it. A Member who objects may close their account at any time.
Article 4 (Interpretation)
Matters not provided for in these Terms, and questions of interpretation, are governed by applicable law and ordinary commercial practice.
Article 5 (Formation of the Agreement)
The agreement is formed when a person applying for membership agrees to these Terms and to the Privacy Policy, completes the registration form prescribed by the Operator, submits the application, and the Operator accepts it.
Article 6 (Registration and Eligibility)
- Only persons aged 16 or older may register. Persons under 16 may not become Members.
- The Operator may refuse an application, or terminate the agreement afterwards, where the applicant:
- uses a false identity or another person's identity;
- enters false information, or omits information the Operator requires;
- applies for a purpose that would harm public order or decency;
- intends to use the Service for an improper purpose; or
- otherwise fails to meet the conditions of use set by the Operator.
Article 7 (Changes to Member Information)
- A Member may view and correct their personal data at any time through the account management screen.
- Where information given at registration changes, the Member must update it online or notify the Operator by email or a comparable means.
- The Operator is not responsible for disadvantage arising because a Member failed to give the notice in paragraph 2.
Article 8 (Protection and Use of Personal Data)
- The Operator takes care to protect Members' personal data as required by applicable law.
- The protection and use of Members' personal data is governed by applicable law and by the Operator's Privacy Policy.
Article 9 (Care of Credentials)
- A Member is responsible for their own username and password and must not allow a third party to use them.
- A Member who becomes aware that their credentials have been stolen or are being used by a third party must notify the Operator immediately and follow its instructions.
- The Operator is not responsible for disadvantage arising from a failure to comply with paragraph 2.
Article 10 (Notices to Members)
- The Operator may give notice to a Member using the email address registered by the Member or a message within the Service.
- Where notice is given to Members generally, the Operator may replace individual notice by posting on a Service noticeboard for at least 7 days.
Article 11 (Provision and Change of the Service)
- The Operator provides Members with:
- game information, guides and materials;
- community boards (general discussion, questions and answers, information, screenshots and similar);
- file and download services; and
- any other service the Operator develops or offers, including through partnerships.
- The Operator may change the content of the Service where operationally or technically necessary, and will announce such changes within the Service.
Article 12 (Suspension of the Service)
- The Operator may suspend the Service temporarily for maintenance, replacement or failure of equipment, loss of communications, or other substantial operational reasons.
- The Operator does not compensate Members for loss caused by suspension arising from force majeure, power failure, or other causes beyond the Operator's control.
Article 13 (Member Obligations)
A Member must not:
- register false information on application or change;
- use another person's information;
- alter information published by the Operator;
- transmit or post information other than that permitted by the Operator (including computer programs);
- infringe the intellectual property rights of the Operator or any third party;
- damage the reputation of, or interfere with the business of, the Operator or any third party;
- publish or post obscene or violent messages, images or sounds, or other material contrary to public order and decency;
- collect, copy, transmit or distribute, without authorisation, information other than their own posts;
- arrange, broker or encourage improper trading in the game (trading for real money, trading accounts and the like); or
- otherwise act contrary to applicable law or to the operating policy set by the Operator.
Article 13-2 (Restrictions on Nicknames and Display Names)
- In choosing and using a nickname, account name or profile display name (a "Display Name"), a Member must not:
- impersonate the Operator, an administrator or a member of staff, or use a Display Name likely to be mistaken for one;
- impersonate the police, a prosecutor's office, a court, or any other government or public body or its officials, or use a Display Name likely to be mistaken for one;
- use a Display Name containing words that suggest operational authority or official standing, such as "operator", "admin", "GM", "notice", "police" or "report centre";
- use a Display Name identical or similar to the official name, domain or official account of the Service, so as to make other Members mistake a message for an official announcement or position;
- set a Display Name identical or similar to that of another Member so as to impersonate them or cause confusion; or
- use an obscene or violent Display Name, or one contrary to public order and decency.
- The Operator may, without prior notice, change or reset such a Display Name, take interim measures against posts, or restrict the Member's use of the Service under Article 17.
Article 14 (Operator Obligations)
- The Operator will not act contrary to applicable law, these Terms, or public order and decency, and will use its best efforts to provide the Service continuously and reliably.
- The Operator maintains a security system to protect Members' personal data, and publishes and observes its Privacy Policy.
- Where a Member raises a comment or complaint that the Operator accepts as justified, the Operator will deal with it.
Article 15 (Management of Posts)
- All rights in, and responsibility for, a post rest with the Member who posted it.
- The Operator may take interim measures (withholding, deleting or moving a post) without prior notice where it considers that the post:
- defames or damages the reputation of another Member or a third party;
- is contrary to public order and decency;
- is connected with criminal conduct;
- infringes the copyright or other rights of the Operator or a third party;
- repeats the same content many times (flooding);
- is advertising or otherwise commercial; or
- otherwise breaches applicable law.
- A Member whose post has been subject to an interim measure may object to the Operator, and the Operator will take appropriate action, including restoring the post, where the objection is justified.
Article 16 (Copyright in Posts)
- Copyright in a post made within the Service belongs to its author.
- A Member agrees that the Operator may use their posts within the Service for the purposes of publication, display and promotion. The Operator will not use them commercially.
- A Member agrees that other Members and third parties may quote their posts for non-commercial purposes, provided the source is credited.
- Copyright and other intellectual property rights in works created by the Operator belong to the Operator.
Article 17 (Restriction of Use and Loss of Membership)
- Where a Member breaches these Terms or interferes with the normal operation of the Service, the Operator may restrict use in stages, by warning, temporary suspension or permanent suspension.
- The Operator may terminate membership where a Member:
- registered false information on application;
- interferes with others' use of the Service, or misuses their information, so as to threaten orderly electronic commerce;
- uses the Service to act contrary to law, these Terms, or public order and decency; or
- has not accessed the Service for one year or more (dormant account handling).
Article 18 (Closing an Account)
- A Member may ask the Operator to close their account at any time, and the Operator will act on the request immediately.
- Personal data held by the Operator is handled in accordance with the Privacy Policy after an account is closed.
- Posts made by a Member remain published after the account is closed. A Member who wants them removed must delete them before closing the account, or ask the Operator to do so.
Article 19 (Purchases)
- In the international service, in-game currency ("Cash") and other paid items are sold only through in-app purchase on the Apple App Store or Google Play. The Operator does not sell them on this website.
- Because those purchases are made through the store, payment, receipts, billing enquiries and refunds are handled first by the store under its own terms and refund rules.
- Statutory withdrawal and refund rights that apply to a Member under the law of their own country are not affected by this Article. Where such a right applies, the Member may exercise it against the Operator, and the Operator will honour it. See the Refund Policy.
- Cash and paid items have no value outside the game, cannot be exchanged for money, and cannot be transferred to another person or account.
Article 20 (Limitation of Liability)
- The Operator is released from its obligation to provide the Service where it cannot do so because of force majeure or a comparable cause.
- The Operator is not responsible for interruption of a Member's use of the Service caused by that Member.
- The Operator is not responsible for a Member failing to obtain, or losing, revenue expected from use of the Service.
- The Operator is not responsible for the reliability or accuracy of information, materials or statements posted by Members.
- The Operator is not responsible for loss caused by external factors such as a change of policy, a discontinuation of service, or an update by a game operator.
- The Operator is not obliged to intervene in a dispute arising between Members, or between a Member and a third party, through the Service, and is not liable for loss arising from such a dispute.
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law applicable to the Member, including liability for death or personal injury caused by negligence, and for fraud.
Article 21 (Governing Law and Disputes)
- Where a dispute arises between the Operator and a Member, both parties will negotiate in good faith to resolve it.
- These Terms are governed by the laws of the Republic of Korea, and disputes not resolved by negotiation are subject to the courts of the Republic of Korea.
- Paragraph 2 does not deprive a Member who is a consumer of the protection of mandatory provisions of the law of the country in which they habitually reside, nor of the right to bring proceedings in the courts of that country where the law of that country gives them that right.
Addendum
These Terms take effect on 13 August 2026.
